Next Tuesdays resumption of debate on the legality of the attempt by the state of Kentucky to seize control of 141 international online gambling domains (see previous Online-Casinos.com/InfoPowa reports) continues to generate significant interest both within and outside of the industry.
Judge Thomas Wingate of the Franklin Circuit Court, who had earlier signed off on a temporary seizure of domains through registrars at the behest of outsourced lawyers working for the state, faced a platoon of legal representatives from online gambling companies, trade associations and public interest groups supporting freedom of speech and the Internet at the initial hearing last week.
Lawyers for both sides argued legal technicalities centered on the legal standing and identification of domain owners and claims that the action against 141 domain names took place “under cover” and with no notice to their clients. They sought a continuation to brief Judge Wingate on matters of law which they contended will demonstrate the court has no jurisdiction and should dismiss the action.
Judge Wingate gave all involved until October 7 to submit detailed legal briefs on their positions and qualifications for legal standing. The judge pointed out that the case was a complex matter in law where decisions reached could set precedents and have far reaching consequences outside the online gambling industry . It was therefore appropriate that those with the right to be heard submitted their arguments for debate and examination.
However, the judge sounded an ominous note when he told lawyers representing the domain names at issue: “You are going to have to eventually pony up and say who these people are.”
In the meantime the judges temporary seizure of the domains remains in place.
The October 7 hearing looks likely to be even more crowded as opponents to the Kentucky states action, which officials have admitted is aimed at forcing operators to bar Kentucky online gamblers and pay unspecified compensation to state coffers, present their arguments in a case that is already attracting wide mainstream publicity.
The states lawyers, employed on a contingency no win no pay deal, have claimed that online gambling falls within existing legislation which prohibits gambling devices because domain names can be classified as such devices, a point that will no doubt be hotly contested. Online gambling is not specifically declared illegal in Kentucky, where Governor Steve Beshear has proved to be a staunch supporter of land-based casino and horseracing activity.
Among those who will have legal representatives present are the Internet Gaming Counsel, The Poker Players Alliance, iMEGA, the Internet Commerce Association and the Americans for Tax Reform, and it is understood that an open press conference is planned for the day before the October 7 hearing where a diverse range of representative bodies will make relevant statements.
The executive director of the Poker Players Alliance, John Pappas is driving the press conference and urges all interested parties to discuss participation with him by using the PPA website.

The US crackdown on internet gambling has created a large and potentially lucrative loophole for fantasy sports leagues, a new report suggests. The study raises further questions about the controversial ban as efforts mount in Washington, D.C., to repeal or amend the sweeping prohibition.
The National Football League and other professional sports leagues were aggressive backers of the 2006 federal ban on internet gambling, the Unlawful Internet Gambling Enforcement Act. The politically-influential leagues have campaigned aggressively against on-line sports betting, fearing scandals that could drag in players and cast a cloud over the integrity of their games.
But while the new law took aim at a wide variety of online gambling activity, it carved out a specific exemption for fantasy sports leagues, argues Joseph Kelly, co-editor in chief of the Gaming Law Review and Economics and a professor of business law at SUNY College Buffalo in New York.
Such fantasy sports leagues have been a boon for the professional leagues, further increasing fan interest in their teams and games. There are now more than 27 million players in the United States with one third playing baseball, and annual revenue is in the range of $800m to $1bn, according to the Fantasy Sports Trade Association.
However, that loophole has unwittingly opened the door to a fast-growing, and so far, legal form of online gambling; one which appears poised to stretch the original intent of the exemption for fantasy sports under the two-year-old internet gambling ban, Kelly warns.
Such concerns come as Congress weighs whether to suspend the increasingly unpopular 2006 internet crackdown. Democratic US Representative Barney Frank, chairman of the powerful House Financial Services Committee, succeeded in pushing through his committee a bill that would have suspended the enforcement of the federal internet gambling ban, though it would preserve the ban on online sports betting.
While an amendment that allows horse tracks to offer on-line wagering generated controversy, the iron-clad exemption for fantasy sports leagues surprisingly generated little press attention, Kelly observes in his article, “Living in a Fantasy”.
“You have some very clever entrepreneurs who could take fantasy sports and define it in such a way that the game will not have any relationship with fantasy sports,” Kelly said in an interview with GamblingCompliance.
In fact, that trend may be already starting to happen, notes Kelly, in his recent Gaming Law Review report. Originally founded by small groups of statistic-crazed baseball fanatics, fantasy sports leagues have been extended to bowling, darts, celebrity leagues and even ‘fantasy Congress’ leagues. “But that trend is likely to move in directions that will push the envelope each further, to the point where the very definition of what is a sport is called into question,” he argues.
Meanwhile, fantasy leagues are increasingly looking like a form of online gambling. Players ante up a fee to play in a tournament, and then compete for a prize or prizes. And those prizes are getting more lucrative as well. Fantasy Fishing Awards, Kelly notes, is “offering a $1m grand prize and 4,000 other prizes in its online game.”
Station Casinos, in turn, which operates the fifth largest sports book, is accepting “wagers based on players’ projected fantasy statistics”, Kelly reports. Some entry fees may be as high as $1,500. More typical is one fantasy baseball league, which charges $29.95 to enter and offers a grand prize of $10,000.
“The entrance fee and the winning of prizes could be considered a bet and therefore be possible illegal gambling,” Kelly writes.
Still, if the coast is clear on the federal level, there are still some potential roadblocks on the state level for would-be online gambling operators, according to Kelly. While the exemption for fantasy sports protects it from federal prosecution under the 2006 internet gambling law, it leaves it up to the states to decide whether to write regulations that would officially legalize fantasy sports.
So far, only Montana has taken this step, but it has also capped profits at 15 percent, effectively discouraging any would-be fantasy sports operators. However, in written opinions, attorney generals in three different states – Florida, Arizona and Louisiana - have concluded fantasy sports are illegal, Kelly writes.
“Attorney general opinions are not law, but they are viewed often by courts as persuasive authority,” Kelly writes.
That said, it is highly unlikely there will any state crackdowns on fantasy sports clubs. For politically savvy district attorneys and attorney generals, there is nothing to be gained – and much to be lost – by going after sports fans. “Some of the biggest names are conducting fantasy sports leagues. I can’t imagine a law enforcement person wanting to get into this,” Kelly said.
By contrast, there have been a few private suits against fantasy sports companies on behalf of individuals who lost money in tournaments run by the firms. So far, none of these suits have been successful.
Nor is there likely to be any action by the major sports leagues, whose main concern is barring online sports betting out of concern it could damage the integrity of their games, said Andrew Zimbalist, an economist at Smith College and one of the nation’s top sports business experts.
“It just increases their following and the intensity of the fan base tremendously,” Zimbalist said. “They certainly don’t want to squelch that activity. It’s low-grade gambling.

Point-Spreads.com has learned that Kentucky Governor Steve Beshear will be successful in stealing some but not all of the 141 online gambling domain names! Several top brands that are in jeopardy include GoldenPalace.com, WSEX.com, SportsBetting.com, FullTiltPoker.com, PokerStars.com CakePoker.com, DoylesRoom.com and several others.
The internet gambling industry was sent in a tail spin when Point-Spreads.com broken the news yesterday morning of the attempted domain name hijacking. Senior management of the various online gambling business entities that own some of the domain names in question were traveling to Barcelona to attend the annual EiG internet gambling industry conference are now finally able to deal with the situation and it does not look good for a few of them.
Some operators have already told Point-Spreads.com that they cannot transfer the ownership of the domain names, they cannot transfer the registrars and are unable to change DNS. Not a good sign at all, but how can that be? Under Rule 8(a) and 8(b) (see below) domain name holders are unable to transfer ownership or move registrars pending a hearing to challenge the request of seizure by Kentucky on Thursday September 25th.
The actions taken by Kentucky also have serious repercussions for anyone working within the e-commerce and internet space.
If that is not a clear case of abuse of power, I dont know what one is, Joe Brennan, Jr. founder of iMEGA, said. The Interactive Media Entertainment Gaming Association was founded to foster cooperation between the online industry and government at all levels, and to promote innovation, openness and freedom on the Internet.
Can a judge in Kentucky actually issue a court order that is enforced by ICANN over a foreign e-commerce business? Before that can be answered, one must understand the jurisdictional issues of “owning” a domain name.
Basically, the jurisdiction used for disputes is either the location of the Registrar that the domain name is stored at or the address on file with that Registrar for the “owner” of the domain name. Several of the online gambling domain names in question were actually stored at Registrar’s located within the United States. Some, if not all of those domain names are going to be seized.
Let’s be real, TwinSpires.com which is a online gambling internet website owned by Churchill Downs Incorporated out of Louisville, the same group that runs the Kentucky Derby, is the biggest benefactor to Kentucky’s attempted to steal the 141 domain names. This is not about protecting its citizens, its about protecting a Kentucky based corporation from having competition in its local market. Shame on the Governor of Kentucky.
The industry needs to take this very seriously and not just the online gambling operators, commented Christopher Costigan, Publisher of Gambling911.com. An order in Kentucky will open the doors for other states to take similar actions and who knows what might be next? Maybe other states will start going after hosting companies for conducting business with Internet gambling affiliates, and even worse they can go after the registrars. The states are hurting right now due to the economy and they are looking for ways to protect key industries such as the land based casinos and - in the case of Kentucky - the horse racing industry. If they see the industry is not going to stand up and challenge these matters, Im afraid to say it but there is almost certainly more bad news to come down the road.
It’s obvious to everyone observing this story that Kentucky did not think this decision through all the way. Could the government of another state or country go after domain names owned by Kentucky businesses if the said state or country deems the activity of said website be illegal? Only time will tell and we will have to wait until after the hearing this Thursday to find out the outcome. Point-Spreads.com urges other operators to make sure that their domain name registrar is one that is based out of the United States and preferablly in a gaming friendly jurisdiction to help mitigate the likelihood of their domain name portfolios from being stolen in the future.

If the Democrats would have nominated a can of tomato soup against Fletcher, they would have won. Start representing the people and quit catering to special interests. This is a free market and you dont make an activity that people enjoy illegal simply to help sustain another sector of industry. That stuff is suppose to work itself out in our free market system. The government certainly is not suppose to step and prohibit freedom as you are trying to do.”

In the event that you transfer a domain name registration to us during the pendency of a court action or arbitration, such dispute shall remain subject to the domain name dispute policy of the registrar from which the domain name registration was transferred.

The internet gambling industry was sent in a tail spin when Point-Spreads.com broken the news yesterday morning of the attempted domain name hijacking. Senior management of the various online gambling business entities that own some of the domain names in question were traveling to Barcelona to attend the annual EiG internet gambling industry conference are now finally able to deal with the situation and it does not look good for a few of them.
Some operators have already told Point-Spreads.com that they cannot transfer the ownership of the domain names, they cannot transfer the registrars and are unable to change DNS. Not a good sign at all, but how can that be? Under Rule 8(a) and 8(b) (see below) domain name holders are unable to transfer ownership or move registrars pending a hearing to challenge the request of seizure by Kentucky on Thursday September 25th.
The actions taken by Kentucky also have serious repercussions for anyone working within the e-commerce and internet space.

Let’s be real, TwinSpires.com which is a online gambling internet website owned by Churchill Downs Incorporated out of Louisville, the same group that runs the Kentucky Derby, is the biggest benefactor to Kentucky’s attempted to steal the 141 domain names. This is not about protecting its citizens, its about protecting a Kentucky based corporation from having competition in its local market. Shame on the Governor of Kentucky.
The industry needs to take this very seriously and not just the online gambling operators, commented Christopher Costigan, Publisher of Gambling911.com. An order in Kentucky will open the doors for other states to take similar actions and who knows what might be next? I mentioned H.R. 6870 in passing on Tuesday, expressing a bit of cynicism about the vagueness of its expressed intention “to ensure...[the UIGEA] does not cause harm to the payments system.” The bill itself, however, is quite clear in the way it expresses its purpose.
There are three sections. The first gives the bill its title.
The second section specifically prohibits the Secretary of the Treasure and the Board of Governers of the Federal Reserve System from finalizing those UIGEA regs, other than to “the extent as any such regulation pertains” to sports wagering (such as was already made illegal by the 1961 Wire Act) or to what the bill says in section 3. This is the section that makes online poker players happy, as it spells out that the UIGEA cannot specifically be used (right now, anyway) to make “financial transaction providers” stop us from sending money back and forth to online poker sites.
The third section looks to the future, providing a directive to the Secretary of the Treasury and the Board of Governors of the Federal Reserve System to keep studying all of this and “jointly develop and implement regulations...that shall include a definition of the term ‘unlawful internet gambling’...after conducting a full economic impact study of the propsed regulations.”
This little addendum, in fact, is where the title of the bill was taken. In essence, the charge to the feds here is for them to continue to try to assess how the UIGEA would affect the banking system should it be extended to apply to other forms of gambling than just sports wagering. What is only being implied here is that if it is determined extending the UIGEA to those other forms of online gambling would harm the banking system, then those additional regs wouldn’t be implemented. (That’s the vagueness I was talking about on Tuesday.)

The UK is the first powerful country in the world to pass laws allowing for the regulation of online gaming. By this September, gambling on the internet will be completely legal in the United Kingdom. Their intention is to invite offshore casinos, which are currently based on third-world islands, to come do business on their free land. Once the transition occurs, the UK will be in position to regulate and tax the 10 billion pound-a-year industry. Over the past year, the UK parliament has actively pursued laws to enable legalized and regulated online gambling within their territory. Taxation plans are currently being negotiated.
Other countries like Italy, who first banned all forms of web based wagering, are now moving to complete legalization through proper regulation. Spain and South Africa are following suit, helping to bring Internet gambling acceptance to the global marketplace. There are some countries, like Germany and France, who are leaning towards prohibition, but their purpose is to protect land-based casino gambling operations. However, protectionism goes against European Union standards and many challenges lay ahead for the liberal continent. At the opposite end of the debate, the United States has declared a prohibitive stance towards the industry citing moral issues as their argument, however they do allow brick and mortar casinos, lotteries, bingo halls, and horse racing tracks to operate legally on their land.
